Arizona lien waivers
Arizona lien waiver forms and rules
Arizona lien waivers are governed by A.R.S. §33-1008, which sets out 4 statutory waiver forms. A waiver that does not substantially follow the statutory form is unenforceable, so Arizona contractors must use the statutory wording.

What are the Arizona statutory lien waiver forms?
A.R.S. §33-1008 provides: Conditional Waiver and Release on Progress Payment; Unconditional Waiver and Release on Progress Payment; Conditional Waiver and Release on Final Payment; Unconditional Waiver and Release on Final Payment.
Copy the wording from the statute itself (linked in Sources). Do not retype the form from a third-party summary: in a mandatory-form state a missing notice or changed sentence can matter.
Use the conditional form to get paid and the unconditional form only after the funds clear. See conditional vs unconditional lien waivers and final lien waivers.
Is the statutory form required in Arizona?
Mandatory. A waiver and release is unenforceable unless it follows substantially one of the four statutory forms.
“The waiver and release given by any claimant is unenforceable unless it follows substantially the following forms”
Key Arizona lien waiver rules
A conditional release protects the payer only if there is evidence of payment: the claimant’s endorsement on a check paid by the bank, or the claimant’s written acknowledgment of payment.
- Unconditional forms must state, in type at least as large as the largest on the document: “This document is enforceable against you if you sign it, even if you have not been paid.”
- An owner or contractor may not waive or impair other persons’ lien rights by contract; any such contract term is void (accord and satisfaction and court settlements excepted).
- Any other waiver statement is unenforceable unless it uses a statutory form or the claimant has actually been paid in full.
- Notarization: Not addressed by the statute; the forms end with a date, company name, signature and title.
How should a general contractor handle Arizona waivers in AP?
Attach the right Arizona form to each subcontractor payment, collect it before the payment is released, and file it against that payment so it can be produced on request.
The form depends on where the project is, not where the subcontractor is based. Frequently asked questions
Does Arizona have a statutory lien waiver form?
Yes. A.R.S. §33-1008 sets out: Conditional Waiver and Release on Progress Payment; Unconditional Waiver and Release on Progress Payment; Conditional Waiver and Release on Final Payment; Unconditional Waiver and Release on Final Payment. Mandatory. A waiver and release is unenforceable unless it follows substantially one of the four statutory forms.
Do Arizona lien waivers need to be notarized?
Not addressed by the statute; the forms end with a date, company name, signature and title.
Can I use a generic lien waiver in Arizona?
Not safely. In Arizona, a waiver that does not substantially follow the statutory form is unenforceable, so a generic form may give the payer no protection. Use the statutory wording.
When does a Arizona conditional waiver take effect?
Only when there is evidence the claimant was paid: the claimant’s endorsement on a check that the bank has paid, or the claimant’s written acknowledgment of payment.
Aequo Build
Stop paying subs before the waiver is in.
With waiver enforcement on, Aequo Build creates a conditional waiver requirement for each subcontractor payment you make from Aequo, holds that payment until a reviewer verifies the waiver or an approver records a reasoned override, escalates overdue requests to the subcontractor and your team, and requests the unconditional waiver once the invoice is paid. It works with QuickBooks Online.
